Know your rights

Never Leave Without Voting: Your Right to a Provisional Ballot

If there's a problem at the polls, you do not have to leave. Under federal law, if you believe you are registered and eligible, you have the right to cast a provisional ballot. It's counted once your eligibility is confirmed.

You can vote provisionally if:

  • Your name isn't on the voter list, but you believe you're registered.
  • You forgot or don't have an acceptable photo ID.
  • The name on your ID doesn't closely match the voter list, or the ID can't verify who you are.
  • You applied for a mail ballot and haven't cancelled it. Tip: bring your mail ballot with you to surrender it, and you can vote a regular ballot.
  • An election official questions your eligibility.
Voted provisionally because of ID? You have 6 days after Election Day to show an acceptable photo ID (or complete a Reasonable Impediment Declaration with a supporting document like a utility bill or bank statement) at the county voter registrar's office so your ballot counts. A notice telling you whether your ballot was counted will be mailed to you.

Before you go: check your registration (opens in new tab) so there are no surprises. Problem at the polls? Call the nonpartisan Election Protection hotline at 866-OUR-VOTE (866-687-8683), or Jefferson County Elections at 409-835-8760.
